## Guest Wi-Fi Terms of Use and Marketing Consent Blair WiFi is a guest Wi-Fi access and management platform provided by Low Volt Ohio LLC. The business, venue, property, organization, or other entity providing the guest Wi-Fi network you are accessing is referred to in these Terms as the “Location.” By selecting the acceptance box and continuing, you agree to these Terms. ### Guest Wi-Fi Access The Location is providing you with temporary access to its guest Wi-Fi network for lawful, personal use. Access is a privilege and may be limited, suspended, or terminated at any time. You are responsible for your device, your activity while connected, and the security of information you send or receive over the network. You may not use the guest Wi-Fi network to: * violate any applicable law or regulation; * access systems, accounts, devices, or data without authorization; * interfere with, disrupt, overload, probe, scan, or attempt to compromise the network or another system; * distribute malware, malicious software, spam, or other harmful content; * engage in fraud, harassment, infringement, abuse, or other unlawful activity; * circumvent security, access controls, bandwidth restrictions, or network policies; or * use the network in a manner that materially interferes with service for other guests. The Location and its service providers may restrict or terminate network access when reasonably necessary for security, network management, legal compliance, or enforcement of these Terms. ### Network Security and Availability Guest Wi-Fi is a shared wireless service. No wireless or Internet connection can be guaranteed to be private, secure, uninterrupted, error-free, or available at any particular speed. You should use appropriate security precautions when transmitting sensitive information. The Location and Blair WiFi are not responsible for third-party websites, applications, services, content, or Internet activity outside the guest Wi-Fi service. ### Information and Privacy When you use the guest Wi-Fi service, information may be collected about your connection, device, session, access method, and information you voluntarily submit through the portal. The use of this information is described in the Privacy Notice presented with this guest Wi-Fi service. That Privacy Notice is incorporated into these Terms. ### Marketing Consent By accepting these Terms, you also affirmatively consent to the Location using the contact information you voluntarily provide through this guest Wi-Fi portal to send you marketing and promotional communications relating to the Location, including offers, events, promotions, products, services, announcements, loyalty or customer programs, and similar communications. Marketing communications may be sent by email and, when you provide a mobile telephone number and the Location uses text-message marketing, by SMS or text message. Text messages may be sent using automated technology. Message frequency may vary, and message and data rates may apply. Your acceptance of these Terms is intended to constitute your affirmative electronic consent to these marketing communications and, where applicable, your electronic signature evidencing that consent. Your marketing consent is provided to the **Location whose guest Wi-Fi portal you are using**. Blair WiFi and Low Volt Ohio LLC may process contact information and facilitate communications on behalf of that Location, but this consent does not authorize Blair WiFi or Low Volt Ohio LLC to use your information to market unrelated Blair WiFi or Low Volt Ohio products or services unless you separately consent to such marketing. Marketing consent is not a condition of purchasing goods or services from the Location. You may withdraw your marketing consent at any time. Marketing emails should provide an unsubscribe method. For text messages, follow the opt-out instructions included with the message, including replying STOP when that option is provided. An opt-out applies to future marketing through the applicable communication channel, subject to reasonable processing time and applicable law. Withdrawing marketing consent does not prevent the Location or its service providers from sending non-marketing communications that are necessary for security, guest Wi-Fi access, verification, service administration, or other communications permitted by law. ### Network and Service Data The Location and Blair WiFi may process technical and operational information reasonably necessary to provide and secure the guest Wi-Fi service, authenticate or authorize devices, manage sessions, measure network performance, troubleshoot problems, prevent abuse, maintain consent records, provide analytics, and operate related guest-service functionality. ### No Guarantee or Warranty The guest Wi-Fi service is provided on an “as available” basis. To the fullest extent permitted by law, the Location, Blair WiFi, Low Volt Ohio LLC, and their respective service providers make no guarantee regarding availability, reliability, speed, security, compatibility, or suitability of the service. ### Limitation of Responsibility To the fullest extent permitted by applicable law, the Location, Blair WiFi, Low Volt Ohio LLC, and their respective service providers are not responsible for loss or damage resulting from your use of the Internet, third-party services, unauthorized activity by third parties, interruption of connectivity, or your failure to adequately secure your device or communications. Nothing in these Terms excludes rights or remedies that cannot legally be waived. ### Changes and Current Terms The Terms presented to you when you request guest Wi-Fi access are the Terms applicable to that access session. Updated Terms may be presented during a future visit or connection.
